California Divorce Laws

According to Cal. Fam. Code 2335 evidence of wrongdoing or misconduct committed by either partner during the marriage is meaningless and unacceptable in divorce proceedings.

According to California Family Code 2320, for a court in California to enter a divorce judgment ending the parties’ marital status, one of the partners must have been a resident of the state for six months, and in most cases, the partner suing for divorce must file in his or her county of residence, where he or she resided for at least three months preceding the filing of the petition. If these conditions are not met, the case could be dismissed by the family court.
